Doctrine
Trial court credibility findings may be preferred when a witness possesses indicia of truthfulness and firsthand investigation, as with Patrolman Acosta's report.
A superior officer's report is not automatically more credible; absence of the alleged witness and lack of investigator qualification may undermine a report's weight.
A mere deficiency, without intent to evade docket fees, does not warrant dismissal; the lower court may assume jurisdiction and the deficiency can be made a lien on the judgment.
Facts
A traffic accident involved three vehicles, including Pantranco bus No. 1202; total damages figures are reflected in the record (see totals).
Patrolman Acosta, a 13-year police investigator and chief investigator, prepared a spot report based on interviews and his own visual inspection of vehicle damages.
Major Bascos submitted a conflicting spot report largely based on an alleged witness Pat. Jose Abrenica, who was not presented at trial and whose presence at the scene was doubtful.
The trial court found the driver of Pantranco bus No. 1202 responsible; Pantranco North Express, Inc. (PNEI) was held liable under the Civil Code for damages caused by its employee.
Issues

The deficiency in docket fees shall be computed by the trial court clerk and shall constitute a lien on the judgment; no pronouncement as to costs.
