Doctrine

Classification of public lands is an exclusive prerogative of the Executive Department; courts may not reclassify public lands or release them from unclassified status.

The State cannot be estopped by the omission, mistake, or error of its officials or agents when such omission concerns classification of public lands.

Conversion of public property does not, by itself, make the land alienable and disposable to private ownership.

Facts

The appeal raised whether presentation of the tracing cloth plan was necessary and whether the land called "Tambac Island" could be registered.

The application originally named Pacific Farms, Inc.; it was later amended to J. Antonio Araneta, Inc., which the Court viewed as an attempt to evade disqualification.

A BF Map LC No. 673 (1 March 1927) showing the property within unclassified region was not introduced in evidence, but the parties had a stipulation; the State cannot be estopped by omission of its officials.

The Court noted that conversion of public land does not automatically make it alienable and disposable by private parties.
