c. Real vs. Consensual Contracts
EXCEPTIONS
Real contracts, such as deposit, pledge and commodatum, are not perfected until the delivery of the object of the obligation (Art. 1316, NCC). And solemn contracts, which are perfected by compliance with the formalities required by law.
Real contracts require consent, subject matter, cause or consideration, and delivery. (Paras, 2021)
