iii. Prescription of Penalties
Prescription of Penalties
Source limitation: The supplied decisions address prescription of offenses or criminal actions, not prescription of penalties. They do not establish when an imposed penalty prescribes or how that period is computed.
In Lim v. People, G.R. No. 226590, 23 April 2018, the Court held that prescription had extinguished criminal liability and dismissed the criminal case. 1 In Jadewell Parking Systems Corporation v. Judge Nelson F. Lidua SR, G.R. No. 169588, 7 October 2013, the Court addressed when filing interrupts prescription for an ordinance violation under the Rules on Summary Procedure. 2 These rulings should not be used as rules on prescription of penalties.
