Grounds for Impeachment

  • Culpable violation of the Constitution;
  • Treason;
  • Bribery;
  • Graft and Corruption;
  • Other high crimes; or
  • Betrayal of public trust (Sec. 2, Art. XI, 1987 Constitution)

NOTE: Once the said impeachable officer is no longer in office because of his removal, resignation, retirement or permanent disability, the Court may proceed against him or her and impose the corresponding sanctions for misconduct committed during his tenure (In re: Undated letter of Mr. Louis C. Biraogo, A.M. No. 09-2-19-SC, 24 Feb. 2009)

The Court dismissed the complaint for failure of Atty. Pena to substantiate his allegations against Justices Carpio and Sereno, and that the same are purely conjectures which cannot be a subject of judicial review. (In Re: Letter Coplaint of Atty. Pena against Justices Carpio and Sereno, A.M. No. 12-6-11- SC, 13 June 2012)
