Parole

Parole is not available to a person sentenced to reclusion perpetua. In Candelaria v. People, G.R. No. 209386, 8 December 2014, the Supreme Court applied Section 3 of RA 9346 and held that such a person is ineligible for parole under the Indeterminate Sentence Law. 1

Parole must be distinguished from good conduct time allowance (GCTA). In Guinto v. Department of Justice, G.R. No. 249027, 3 April 2024, the Court held that Article 97 of the Revised Penal Code, as amended by RA 10592, permits a convicted prisoner serving sentence in a penal institution, rehabilitation or detention center, or local jail to earn GCTA; implementing rules cannot add statutory disqualifications. 2
