Concept
A minor’s work schedule is subject to limits based on age. For children below 15, the hours rule applies only where employment falls within a permitted exception. For those aged 15 but below 18, the law fixes daily and weekly ceilings and prohibits work during specified night hours. (Special Protection of Children Against Child Abuse, as amended by Rep. Governing provisions
The Special Protection of Children Against Child Abuse, as amended by Republic Act No. 9231, sets out the age-based hours and night-work limits. Republic Act No. 6237 also states hours and night-work restrictions using different age brackets and time periods; its text should not be substituted for the limits stated in the amended child-protection provision. Requisites / Rules
- Below 15: In employment allowed under the stated exceptions, the child may work for no more than four hours on any given day and 20 hours in a week. The child may not work from 8:00 p.m. to 6:00 a.m. of the following day. (Special Protection of Children Against Child Abuse, as amended by Rep. Act No. 9231)1
- 15 but below 18: The child may not work for more than eight hours a day or 40 hours a week, and may not work from 10:00 p.m. to 6:00 a.m. of the following day. (Special Protection of Children Against Child Abuse, as amended by Rep. Act No. 9231)1
- Apply both measures: Compliance with the daily ceiling does not dispense with the weekly ceiling. Likewise, a shift within both ceilings must still comply with the applicable prohibition on night work. (Special Protection of Children Against Child Abuse, as amended by Rep. Act No. 9231)1
Distinctions
The amended child-protection provision divides minors into those below 15 and those aged 15 but below 18. By contrast, Republic Act No. 6237 refers to children below 16 for its seven-hour daily and 42-hour weekly limits and addresses night work for children below 18 using a 6:00 p.m. to 7:00 a.m. period. For current-law questions, apply Republic Act No. 9231’s age-based daily and weekly limits and prohibited night-work hours; discuss Republic Act No. 6237’s different figures only if the question specifically asks about that statute or its historical text. Key doctrines
Permission to employ a child and permission to schedule that child’s work are separate questions. Meeting an hours limit does not itself establish that employment is allowed: the amended child-protection provision generally bars employment below 15, subject to its stated exceptions. Exceptions
