Elements:

  • large cattle is taken;
  • it belongs to another;
  • the taking is done without the consent of the owner or raiser;
  • the taking is done by any means, method, or scheme;
  • the taking is done with or without intent to gain; and the taking is accomplished with or without violence or intimidation against persons or force upon things (Lopez v. People, G.R. No. 212186)

Art 311. Theft of the Property of the National Library and National Museum

General Rule: It has a fixed penalty regardless of its value – Arresto Mayor or a fine ranging from ₱40,000 to ₱100,000, or both.
