- Insanity
- State of being deaf-mute
- Imbecility
- Civil interdiction
- Prodigality - state of squandering money or property with a morbid desire to prejudice the heirs of a person (Martinez v. Martinez, G.R. No. 445, 1902)
NOTE: But these do not exempt the incapacitated person from certain obligations
