d. Unified Legal Aid Service (AM 22-11-01-SC)
UNIFIED LEGAL AID SERVICE (A.M. NO. 22-11-01-SC)
Concept
The Unified Legal Aid Service (ULAS) requires Covered Lawyers to render Pro Bono Legal Aid Services. These are legal services provided free of charge to Qualified Beneficiaries and involving the application of law, legal procedure, or legal knowledge, training, and experience. The requirement concerns the lawyer’s service, not merely attendance at a legal aid activity. (Rule 2, Sec. 1, A.M. No. 22-11-01-SC)1 (Rule 4, Sec. 2, A.M. No. 22-11-01-SC)2
Governing provisions
Rule 2, Sections 1 and 2 establish the mandatory duty and identify Covered Lawyers. Rule 4, Section 2 describes the services that may constitute Pro Bono Legal Aid Services. Rule 6, Sections 1 and 2 address applications to accredit legal outreach programs or legal missions and the activities that may be accredited. (Rule 2, Sec. 1, A.M. No. 22-11-01-SC)1 (Rule 2, Sec. 2, A.M. No. 22-11-01-SC)3 (Rule 4, Sec. 2, A.M. No. 22-11-01-SC)2 (Rule 6, Sec. 1, A.M. No. 22-11-01-SC)4 (Rule 6, Sec. 2, A.M. No. 22-11-01-SC)5
Requisites / Rules
- Coverage. All members of the Philippine Bar are Covered Lawyers unless excluded under Section 3, Rule 2 of the Manual. Covered Lawyers must render Pro Bono Legal Aid Services in accordance with the ULAS Rules and the Manual. (Rule 2, Sec. 2, A.M. No. 22-11-01-SC)3 (Rule 2, Sec. 1, A.M. No. 22-11-01-SC)1
- Service. Examples include representation before courts and quasi-judicial bodies, including related pleadings and submissions; legal counseling; assistance in contract negotiations; and drafting legal documents. The listed services also include developmental legal assistance, participation in accredited outreach programs and legal missions, and notarization of documents. (Rule 4, Sec. 2, A.M. No. 22-11-01-SC)2
- Accreditation applicants. A Covered Lawyer, Registered Organization, or group of Covered Lawyers may apply to accredit an outreach program or legal mission for Qualified Beneficiaries. The IBP, through its National Office or Chapters; the Department of Justice, through its Action Center and regional offices; and law school legal aid clinics may also apply. (Rule 6, Sec. 1, A.M. No. 22-11-01-SC)4
- Accreditable activities. Examples are jail visitations and decongestion activities, legal clinics, and legal seminars. In every instance, the activity sought to be accredited must be intended to provide Pro Bono Legal Aid Services to Qualified Beneficiaries. (Rule 6, Sec. 2, A.M. No. 22-11-01-SC)5
Distinctions
Pro Bono Legal Aid Services describe what is rendered to a Qualified Beneficiary; accreditation concerns a legal outreach program or legal mission. Thus, a legal clinic or seminar is an example of an activity that may be accredited, while counseling, document drafting, and rights-awareness training are examples of services described under Rule 4. (Rule 4, Sec. 2, A.M. No. 22-11-01-SC)2 (Rule 6, Sec. 2, A.M. No. 22-11-01-SC)5
Key doctrines
The preamble grounds the measure in the Supreme Court’s rule-making power concerning legal assistance to the underprivileged and in the constitutional protection against denial of access to courts, quasi-judicial bodies, and adequate legal assistance by reason of poverty. (Preamble, A.M. No. 22-11-01-SC)6
Exceptions
Rule 2 recognizes exclusions under Section 3 of that Rule, but the supplied text does not identify the excluded members. Do not assume that every Bar member is covered without checking that provision. (Rule 2, Sec. 2, A.M. No. 22-11-01-SC)3
Bar tip
For an outreach question, identify both the proposed legal service and its intended Qualified Beneficiaries; Rule 6 requires the latter for accreditation. (Rule 4, Sec. 2, A.M. No. 22-11-01-SC)2 (Rule 6, Sec. 2, A.M. No. 22-11-01-SC)5
