(c) Period to Appeal

Modes of appeal with respect to criminal cases:

  • Notice of Appeal pursuant to Sections 3(a) and 6, Rule 122 of the Rules of Court1 to the CTA in Division with respect to an appeal from criminal cases decided by the RTC in the exercise of its original jurisdiction
  • Petition for Review under Rule 432 to the CTA En Banc with respect to criminal cases decided by the CTA in Division, whether in the exercise of its original or appellate jurisdiction
  • Petition for Review under Rule 43 to the CTA in Division with respect to criminal cases decided by the RTC in the exercise of its appellate jurisdiction. (Sec. 9, Rule 9,A.M. No. 05- 11-07-CTA3)
  • For each of these three modes, the initial period to appeal is 15 days from receipt of the decision or final order. For a petition for review to the CTA En Banc, the court may, for good cause, extend the filing period by no more than 15 days.

The Solicitor General shall represent the People and government officials sued in their official capacity in all cases brought to the CTA in the exercise of its appellate jurisdiction.
