2. Principal and Accessory Penalties
Offender as accessory to treason, but a principal in the crime of misprision
The offender under Article 116 is punished as an accessory to the crime of treason, which is two degrees lower than the penalty for treason, but is a principal offender in the crime of misprision of treason. Misprision is a separate and distinct offense from the crime of treason (REYES, BOOK TWO, p. 21)
Knowingly concealing such evil practices
Concealing knowledge of a conspiracy to commit treason is punishable as misprision of treason under Article 116. The offender is a principal in that distinct offense, although punished as an accessory to treason; an accessory under Article 19 participates after the crime has been committed.
