Requisites for the Issuance of the Writ of Preliminary Injunction
A writ of preliminary injunction is issued upon the applicant’s showing of two important requisite conditions:
- The right to be protected exists prima facie; and
- The acts sought to be enjoined are violative of that right. (Bicol Medical Center v. Botor, G.R. No. 214073, 2017)
