Co-existence of Damages

Amount of award in qualified rape

For qualified rape, where the penalty imposed is death but reduced to reclusion perpetua because of RA 9346, the amount of damages to be awarded are as follows:

  • Civil indemnity – P100,000.00;
  • Moral damages – P100,000.00;
  • Exemplary damages – P100,000.00. (People v. Jugueta, G.R. No. 202124, April 5, 2016)
