What is the effect of actions of organs of international organizations created by treaty
Although international organizations have personality in international law, their powers and privileges are by no means like those of states. Their powers and privileges are limited by the constituent instrument that created them. (Bernas, Public International Law, 2009).
International organizations are governed by the “principle of speciality,” that is to say, they are invested by the States which create them with powers, the limits of which are a function of the common interests whose promotion those States entrust to them. (Bernas citing Advisory Opinion on the Use of Nuclear Weapons, July 8, 1996).
