4. Solo Parent Leave (RA 8972, as amended by RA 11861)

Parental (Solo Parent Leave)

Benefits granted to a solo parent to enable him/her to perform parental duties and responsibilities where physical presence is required. The parental leave, in addition to leave privileges under existing laws, shall be for seven (7) work days every year, with full pay, consisting of basic salary and mandatory allowances fixed by the Regional Wage Board, if any, provided that his/her pay shall not be less than the mandated minimum wage. (IRR of R.A. No. 8972, Sec. 6[g])

Conditions to Entitlement

He/she has rendered at least six months of service, whether continuous or broken; He/she has notified his/her employer of the availment thereof within a reasonable period. He/she has presented a Solo Parent Identification Card to his/her employer which may be obtained from the city or municipal social welfare and development office where he/she resides (IRR of R.A. No. 8972, Sec. 19)

Availment

A parental leave of not more than 7 working days every year shall be granted to any solo parent employee who has rendered service of at least 1 year.

Non-Conversion to Cash

Unused parental leave is not convertible to cash unless otherwise provided by the CBA. (IRR of R.A. No. 8972, Sec. 20)
