2. Others - Trust Relationships
Under Article 1491, the following persons are prohibited from purchasing certain property, whether directly or through another person:
- Guardians, agents, executors, and administrators. A prohibited purchase involving them may be ratified because it involves a private wrong; ratification is, in effect, the making of a new contract.
- Public officers and employees, justices and judges, officers of the court, and lawyers. A prohibited purchase involving them cannot be ratified because it involves a public wrong.
