6. Special Leave Benefits for Women due to Gynecological Disorders (RA 9710; DO 112, s. 2011)

R.A. No. 9710 or the Magna Carta for Women

A special leave benefit for women was granted under R.A. No. 9710 (August 14, 2009). Women who qualify under R.A. No. 9710 are entitled to a special leave benefit of up to two (2) months with full pay, depending on the recuperation period certified by a competent physician, based on her gross monthly compensation following surgery caused by gynecological disorders.

Conditions for Entitlement:

  • A woman employee must have rendered continuous aggregate employment service of at least six (6) months for the twelve (12) months immediately prior to the surgery
  • She has filed an application for special leave with her employer within a reasonable period of time prior to the expected date of surgery or within such period as may be provided by company rules and regulations or collective bargaining agreement; and
  • She has undergone surgery due to gynecological disorders as certified by a competent physician.
